Legal Action against P.W. (Riquelme Site)

While my daughter was over at our apartment in December she got talking to a group of owners who were looking to take legal action against Polaris World. This was with regard to the lack of facilities on site and with regard to the town centre which is now not looking like it is going to happen. It also appears that Polaris still do not have planning permission for the conversion of the old hacienda into the club house.
This is very frustrating as it makes it very difficult to let out or properties with such lack of facilities and being so far away from anything that you need to have a car.
I would be very interested in joining this group as would my friends who have an apartment on phase 4. They havn't even furnished their house yet as they wouldn't let it out under the circumstances and have had the keys now for a whole year. They have a cheek to be looking for such exhorbitent community fees when we can't even get using the facilities and the place is still like a ghost town.
I am very dissappointed with the whole set up and am now looking to sell if it is even possible to do that.

hi Anne
just read your email re-the building or should i say the not building of the town centre on HR
we got or keys in oct 06 we have been out several times, but you are right i feel we are being ripped of with the community fees, and lack of facilities. it is very boring nothing going on, not enough going on  at night to sit outside a wooden hut for  very long.
we have spent a fortune on car hire, and petrol going out and about, as i find it difficult to sit outside all day doing nothing. when we got a list of community charges for our block, i  discovered that we are paying the highest fees in the block when i asked why this was i was informed that it was because we have a better view then the others i cannot see it ? 

we would sell but due to the general situation i think we would loose out. i think the only thing to do is to sit on it for a while and hope things pick up.

it is very frustration and i cant believe how slow the Spanish people are, if i had known what was to happen on HR we would not have bought it.

we did ask if we could swap onto another site when we were initially delayed but we were told that we could not move as we had already committed to buying on HR. we now know why they said this as they would never have sold any if people had known the situation.

What a shame and the pity is El Valle is in the same boat I understand - no town centre - just a club house with a small supermarket on the side and the only other facility the golf course.  There is a walled off space where the hotel was going to be built, but I understand that is not happening either at the moment. 

We have just got back from Spain and the other day had a drive through the countryside past Peraleja and then Hacienda Riquelme - I also can't understand why when you are so relatively remote that Polaris have committed even the most basic facilities for what could have been a fantastic resort for them.

The good thing is that hopefully when the other nearby resorts also develop a bit there will be opportunities for meeting up with other people etc - for example us lot on LT Golf.

i am very disillusioned with P/W and all their false promises, do you think there would be enough owners wanting to take legal action against P/W , and some kind of protest about the community fees we are paying, we have not got what we were promised, but we are paying through the nose for it all the same.
I really do not want to go to our property, we have spent a fortune on it. my husband would go out at the drop of a hat as he just like the sun, but i am not very intrested in it and wish we had not bothered buying it.

Hi Anne,

I agree that PW have lead us up the garden path on this.  There is no doubt that they sold the site to us on it's rentability, and we were told that the village would be ready before our apartment.  Although our apartment was 18 months late, there was no town centre, and we are still in the same position.
I thought that I would start with the President of the Community, and e-mailed her to suggest that we should be putting some pressure on PW for compensation.  Curiously, the President didn't agree with me, suggesting that the problem lay with the Murcia authorities.  I don't accept this as PW has had 5 years to get their act together.  It seems that most are just prepared to put up with this.  the British just don't like to complain, but this situation is costing us all a fortune.

We need to get together to put pressure on PW.

Chris,

I agree completely, PW have misled everyone. The issue now is what can we do from this point on. The argument on who is responsible is pointless. Every owner has and will continue to lose money whilst PW are content with their profit and the management company continues to recieve maintenance charges. I do not think that withholding maintenance fees is the answer (the site will degenerate further).

Some action is required by ALL owners now. Obviously the Community President is not getting it and it is incumbent upon ALL owners to do something about it. The forthcoming community elections will provide an opportunity for all to make a stand. To preserve any sort of value of your investment, a definitive plan needs to be put in place to progress the town centre. Whether this needs to be a legal action (I do not think a public legal battle will benefit PW or Mr Nicklaus's reputation) or something else is up to EVERYONE!

First we need to establish our legal position.
Secondly, we need to establish IF there is ANY funding to complete the work, if not where is the funding coming from?
Thirdly - who owns the town centre? - if we do, then it is our hands to do something about it; This may mean that we need to employ a proactive management company (the current one appears to be useless) and progress the build. Dare I say - even at our expense! ALL owners have already lost 20%. If the town centre is not completed the apartments are not saleable or rentable and therefore, we will continue to lose money anyway.

Lets stop the talk and DO SOMETHING!

“Polaris World” cannot pay its debts

Polaris World, a company that promotes, develops and builds holiday resorts, should have paid 20 million euros to the town halls of Torre Pacheco and Alhama de Murcia but it has not been able to do so. The payment has been delayed for one year, based on a guarantee from the saving banks that have traditionally financed the mega-projects in Murcia.

The Mayor of Torre Pacheco, Daniel Garcia Madrid (PP) and Facundo Armero, one of the founders and up to recently principal shareholder in the company, have been under investigation for two years.
