BUYERS at Trampolín Hills golf resort have been offered the chance to build the homes they have already paid for.

The scheme was finally approved by Campos del Río town hall on January 22 in a full council meeting more than three years after the first houses were sold. Dozens of British clients purchased properties at the stalled development which was advertised on billboards in many parts of the Costa Blanca and Costa Cálida.

Grupo Trampolín president Antonio Martínez said he was extremely happy it had now been given the go-ahead. “All the company and I ever wanted was to build the properties,” he said.

Now they have launched a special campaign through their website to recruit 500 employees to construct the resort. “The customers who have been waiting for their homes all this time and who are now unemployed will have priority over other applicants,” Sr Martínez said.
“It is our way of rewarding their trust in us.”

Sr Martínez vowed his company would be able to build the resort despite the general financial crisis. And he said the change of land use of the two million-square-metre plot of land where the resort will be built would be carried out shortly.

“The land will be reclassified to building land which will mean 85 million euros assets for the company to support the building works,” Sr Martínez stated. According to the company the initial works are scheduled to start in March.

However Partido Popular (PP) spokesman in Campo del Ríos Miguel Buendía said it would be at least eight months before building can begin.

He explained the regional government had to approve the scheme first and then several administrative procedures would have to be carried out by the company and the town hall. “The land must be reclassified, then the ‘plan parcial’ must be approved in a full council meeting,” he explained.

“Later on the urbanisation layout must be approved and finally a licence to build the infrastructure has to be issued by the town hall. “According to the law the properties are only allowed to be built once the infrastructure work has been completed.”

The councillor, who voted against the passing of the scheme, also said they would keep on fighting in the courts and they would not withdraw their accusations.  The PP has alleged that there were irregularities in the documents drawn up in the Trampolín Hills file and environmental laws were not respected.

We have been waiting now for three years, we have travelled to spain to talk to people who said we will receive our oney back but still we E mail weekly . It was said on murcia regional channel news by grupo trampoin hills GT cheif exec Juan Francisco Canales that Clients will be able to recover their money after the contracts have expired can any one tell us any other way of reaching these people who hold our money and how we can make them take responsibility Why does nobody answer our E mails at Trampolin any more. Can you  shed light on this . Is there a group that we can join to help each other, any news please Chris And Sue England.

Perhaps the other buyers on the forum can advise if there is a action group that you can join. Have you obtained a Bank Guarantee through your lawyers?

Trampolin Bouncing Away

Cheques maybe! Trampolin Golf Resort has run out of money and, according to information published in the B.O.E (official state bulletin), is now in receivership. The owners of Trampolin Hills Golf Resort, Antonio Martinez Gonzalez and Rafael Aguilera Serna, are in heaps of trouble. Click here for the B.O.E information

They have denied reports in the press that the judge in instruction court 2 in Mula has served them with a notice giving them 24 hours to lodge €30 million into court in order to ensure that the pending civil suits are paid. The notes from the court state that the judge believed that the company had widely publicised homes for sale on a resort built by a company that had only €3,000 capital.

The judge noted that Trampolin Hills Resort targeted a large amount of its publicity at the Irish and British.

The owners of Trampolin Hills have denied receiving the notice and are instead stating that their architects will be presenting plans to the Planning Department of Campos del Rio council. They also added that they are determined not to give up and are hoping to stop the receivership process and return to building as soon as possible. According to the court’s judgement, if the owners of Trampolin Hills Resort do not deposit the €30 million within the specified time, then the sequestration process of their own personal assets will begin.

On another note the Residents’ Association at Trampolin’s other resort in Valle del Sol was once again stood up by the president of the community, co-owner Antonio Martinez Gonzalez, when the members called a meeting in which they planned to vote in another president.

Residents of the Valle del Sol resort have complained repeatedly about the blackmail they claim to have been subjected to by Antonio Martinez Gonzalez. Residents were allegedly first forced to pay €3000 within five days or their electricity would be cut off and then they were faced with more demands, this time on a monthly basis of €400.

These funds had to be paid in cash or by a cheque made out to the bearer. Many residents who complained about the company’s behaviour were disappointed that the judge had not ordered the imprisonment of the two co-owners. Time will tell.

Purchasers of property at Trampolin Hills in Campos del Río, will now be treated as ordinary creditors for monies paid

British and Irish owners who fear that they may lose their money with the collapse of the Trampolin Hills Golf Resort in Campos del Río, Murcia, have until December 2 to register their claim with the authorities.

The company is reported to have sold hundreds of properties to UK and Irish buyers, and has now been forced into administration with 2,500 homes left unfinished and without planning permission in the first place.

Cashquestions.com reports that Antonio Guillen, a lawyer with DWF in Manchester, says that buyers must ensure they are on the list of creditors before December 2, and should supply details of any documents which show payments made. The lawyer notes that the presence of a bank guarantee could mean the difference between them getting their money back or not.

Such a guarantee is required under Spanish law, but not all developers comply. In this case it seems that a guarantee was not in place as the developer has just been fined 350,000 € by the regional government for not presenting one.

The owners of the Trampolin Hills Golf Resort are named as Antonio Martínez González and Rafael Agiulera Serna, and they also face fraud charges and have currently been set bail at 30 million €, an amount they are appealing.

Those who are in the situation are advised to contact a lawyer who specialises in Spanish insolvency law.

Last May a judge in Murcia, José Miñarro García, warned that massive losses could be seen, and condemned the Socialist local council for ‘turning a blind eye’ to what was going on.

Trampolin Hills Owners Ordered To Pay €365,000:

The Ministry of Health and Consumers has issued a fine of €365,000 to the owners of Trampolin Hills Resort for not being able to guarantee the deposits paid by buyers for properties on the urbanization, which the company hoped to build in Campos del Rio on the outskirts of Murcia.

The official bulletin for the region of Murcia stated on Tuesday 17th November that €350,000 of the fine had been issued for failing to guarantee the deposits and a further fine of €15,000 had been imposed for issuing what they call abusive contracts.

The urbanization in Campos del Rio, which Trampolin Hills was hoping to build, included 2,573 homes of which 1,855 have already been sold and for which the company has received €57.988.762 as part payment. These homes have not yet been built and are lacking any planning permission. Trampolin Hills Resort has been given 30 days in which to appeal the fine, meanwhile the obligation to deposit €30 million into an account to guarantee the civil actions that are expected to follow has still not yet been received by the courts and the company has been given a further two weeks to comply.

Many of those who bought on Trampolin Hills are either British or Irish nationals and they are facing the possibility of losing their initial investment unless they register their claim before 2nd December.

The Consumers Department in Murcia has advised anybody that has purchased or placed a down payment on any property on the Campus del Rio Resort by Trampolin Hills should seek legal advice otherwise they could be in real danger of losing their money.

Many of the purchasers were issued bank guarantees by Trampolin Hills. In theory this should mean that their initial investment is covered. However, the courts in Murcia have discovered that the bank guarantees given are not valid in Spain, as they were issued by foreign banks, mainly a bank in Switzerland, which is not under any legal obligation to meet the bank guarantees issued by the company.

The owners of the Trampolin Hills Resort, Antonio Martinez Gonzalez and Raffael Aguilera Serna, will soon see their own personal assets frozen if the €30 million is not paid into the court within the specified timeframe.

You know the one thing that I don´t understand abiut the Spanish system people are owed millions for money that have paid out but the systems is going to take €365k out of that pot in fines, great €365k that the investors loose

Trampolin Hell

TRAMPOLIN HILLS is nestled in between the mountains of North West Murcia and has been in the headlines for many months.

Last week RTN, along with a news crew from Madrid, took a trip down to Campos del Rio to meet the President and two committee members of the Association for the Affected of Trampolin Hills and, we hoped, a director of the company responsible.

Trampolin Hills was an ambitious development project with 2500 houses; all surrounding a beautiful 18 hole golf course. The furthest the company got to building these houses was the five show homes which sadly, are now in a significant state of disrepair; having been stripped of all their contents, including light sockets, and been subjected to a barrage of vandalism.

The company behind the project, Grupo Trampolin, was declared bankrupt in October 2009 leaving more than 1300 people out of pocket; many of whom had put down significant deposits of between 70,000 and 100,000 euros. In fact, the company had received over 53 million euros worth of deposits and now they have nothing but debt.

MEANINGLESS

The Association was keen to make it clear that although they are furious about their situation, they still would like their houses to be built and are currently trying to get the bankruptcy order overturned. The reason that they are trying to do that is because if the company remains in bankruptcy, they have no hope at all of getting their homes built.

Whereas if the company comes out of bankruptcy, there is hope that someone will see the potential in the project and realise that it will create hundreds of jobs, which are desperately needed in the area. The representatives from the Association all agreed that bankruptcy was not the solution and all were shocked to see the state of the show homes at the site.

Anne told RTN: “We feel that this is a sad and meaningless waste of resources.” There were no final licences issued for the development by Murcian authorities, so even if the Association is successful in getting the order reversed, new planning permissions and licences would be required. So, it could be at least another three years before building could start again.

UNBELIEVABLE

Norwegian born Anne Cenname from the Association told RTN: “We need to get as much publicity as possible and highlight our situation, hence the TV crew and your invitation here today.” Some of the affected owners have taken their cases to the European Parliament, but that doesn’t seem to have had any impact. Anne commented: “I can’t believe that they are going to abandon this project.

We are in a crisis and this development will create lots of work and bring people to the area which will create money for local businesses. It is unbelievable. The owners, the company and the Town Hall all want to start building, so we need a solution. We can’t just sit back and lose our life savings. We can’t have our lives over again, so we need to find an answer. It is so very sad. No-one is doing anything to resolve the situation or taking responsibility. There is no-one to defend the rights of the buyers.”

VILLAS

Despite all the stress that this situation is causing, the trio are remarkably optimistic, especially if the judge does change the bankruptcy order. Anne concluded: “We are adamant that we will continue to fight this and get our homes built.”

There is no doubt that the spot where the Trampolin Hills is situated is stunning. Views of the mountain ranges envelop the area. But then as you survey the land, which should now be full of stunning detached villas, to the left is a piece of land with ten abandoned cement lorries and to the right are seven towering cranes standing idle, rusting away.

It’s hard to think that this site will ever be developed; it’s a very sad state of affairs. Needless to say, a Director of the company responsible for this mess failed to show up to be interviewed.(Roundtown News)

Trampolin Hills and Solera ordered to pay

The Provincial Courts in Murcia ordered the companies Trampolin Hills Golf Resort and Solera S.L. Trampolin to pay back 703,000 euros to 20 people who bought homes off-plan. The homes were to be built on the urbanisation located in the municipality of Campos del Rio, which has never materialised.

The Provincial Court in Murcia overturned a previous ruling from the courts in Mula, which determined that Trampolin Hills Golf Resort and Solera S.L. Trampolin were individual companies so therefore one could not be held responsible for the others debt.

The Provincial Court in Murcia have decided that it has been sufficiently proven that the two companies whilst they were set up as separate entities were actually being run by the same administrators, the same directors, had the same employees and the same fiscal address of El Garruchal in the Gea y Truyols area of Murcia.

 According to the court, whilst each company appeared to be it's own individual entity they both did exactly the same activity and are therefore both equally responsible for the debts of either one company or the other. Both companies also fell under the umbrella of Trampolin Group, which took on several real estate projects in the Region of Murcia.

Buyers unlikely to get cash back:

Whilst some 20 people who bought off-plan properties in Campos del Rio are likely to get the majority of their money back following a court decision, the people that invested in the Royal Dream's urbanisation in Albudeite (which was being promoted by Trampolin Hills) are unlikely to get any of their money back.

According to the courts, Solera - which went into receivership last January - was going to build the Royal Dream's urbanisation in Albudeite which involved building 350 to 400 luxury homes with an average price of 170,000 Euros. This urbanisation was to be built on a 27,000 square metre plot which was compromised of 10 rural farms which the company had bought previously.

The properties sold off plan and purchasers paid their funds to Solera. However, the money has not been accounted for - according to the court the money went into an account which they believe was going to be used to benefit the company directors Rafael Aguilera and Antonio Martinez.

Both Aguilera and Martinez have denied that they intended to use the funds for there own personal gain; instead the funds were used to purchase the farms. According to the court the bank guarantee which was given by a company called Swiss Financial was not authorised to trade in Spain so, therefore, are not responsible for the 8.5 million Euros of bank guarantees which are owed to the people who purchased the properties off plan.

Due to the dire state both Trampolin Hills and Solera's financial situation it is unlikely that any of the people who parted with their hard-earned cash will be reimbursed.

Residents Claim Trampolin Hills owner is hiding assets:

The saga continues with the scandal in the Trampolin Hills Golf Resort. Hundreds of people who bought homes off-plan on the Trampolin Hills Resort have been left without their homes and, indeed, out of pocket.

 A group of residents that have been affected by this Trampolin Hills Golf Resort scandal have presented a list of assets to the judge which they believe have been transferred out of the name of the owners of the Trampolin Group to other family members and friends; consequently, they cannot be sold and used to pay back some of the money owed to the people who have purchased off-plan properties.

According to this group of residents, there are several residential plots owned by Solera Trampolin in Albudeite which now have been placed in the names of two women that were close to the company's director Antonio Martinez.

 According to the resident's lawyer, Joaquin Guzman Antonio Martinez also transferred ownership of his yacht "Fairline Squadron", which he had bought in Barcelona, to another family member. Included in the list that was presented to the Judge was a villa that Rafael Aguilera, one of the partners in the Trampolin Hills Golf Resort, has now been (allegedly) placed in the name of Lithuanian women.

A list of a fleet of cars including several Porsche Cayenne and other luxury vehicles has also been presented to the Judge which, according to the information from Trafico, are not listed as pertaining to either Rafael Aguilera or Antonio Martinez or, indeed, either of the companies that fall under the Grupo Trampolin umbrella. The Judge has admitted the list and the prosecution will be looking into the residents' claims.
