Hi everyone

Just to let you all know that Dave and I took another trip out to Murcia last week and visited United Golf and have decided to pull out!

However some useful information we found out whilst out there talking to the locals which maybe of help to some of  you!

There are apparently 2 types of building licences in Spain one is for residential build the other for holiday home - the residential licence means that the building is built to a better specification.

If renting a property out for a long term let BEWARE there is, apparently, a loophole in the Spanish system - if you do a long term let only do it for 11 months of the year or less because if you do it for a more the renter can legally stay in your property for up to 5 years rent free!!!

We visited the local beach Santiago de Ribeara (can't remember how you spell it) and there is a great fish restaurant that the locals use - looks tatty but you can buy fresh fish there and eat - very good! doesn't open til 8.30pm but worth the wait.

Also on the beach there was a huge stage and some kind of festival going on - looked good but again didn't start until 11pm!

Anyway would like to keep in touch and see how it all developes and would like to wish you all luck with United and enjoy your get together

Have taken some photos for you all and posted them so hopefully you will be able to view those soon - they have apparently started work on the commercial area (although they couldn't confirm that!)

Hi Theresa and Dave,

Sorry to hear your decision is to pull out of purchasing at La Tercia. It’s not an easy decision and I hope that you eventually find your perfect home in the sun.

You mentioned that there are two types of building licence; I’ve never heard that before. Did that influence your decision with La Tercia? What type of licence do they have?

Hi Teresa & Dave,

I got an email today from my solicitor to advise me that he would not recommend a purchase with La Tercia as all the licenses were not in place.

To be honest this surprised us as we were told that UGR had all that sorted - apparently in January - "They had problems with the assessment of the land, with the planning permission and building permits and consequently with the obtention of the certificate of fitness for habitation" - this has un-nerved us and we are hoping to get clarification on the matter soon otherwise we will remove our deposit to another development.  We have been advised to look at Medina Elvira, Granada - all icenses in place.

I hope you find was you are looking for - we really like La Tercia but busines is business and if we have to move our deposit we will too.

Does anyone on the forum have any further information that could help?

Hi Billy and Mary Rose,

This is of great concern. I was under the impression that the only licence not in place was the golf licence. We were told by United last month they had been granted the licence and would be in possession of the paper work in the next couple of weeks. Therefore, that being true all would now be in order.

I will email United immediately for conformation that all licences are in place.

Many thanks - would hate to have to start looking again - its all so confusing when there is so much chose.  The solicitor I spoke with this morning was quite adamant and then he emailed me.  Hopefully since he last dealt with UGR every thing is sorted. 

Our agent said he would also check with Teresa in themorning up at La Tercia. He was of the impression that the water license was the last one and that was granted.  Could you check out what the difference is between a residenial license and a holiday home license and query implications for owners if any?

Any word on how many Spainish may be taking up residence with us?  Its always a good sign if the Spanish move in.  I'm hoping the area will have a real residential lived in feel as opposed to it being  a ghost town for part of the year.

We are not sure that the phone number works, I think that Dave tried it the other day with no luck.

Dave might have more idea how many Spanish have purchased.

Hi All

I`am just checking the paperwork and I have a letter from our lawyer, and also the letter from Vicus Consulting who are representing UGR.informing us that they are in possesion of the building permit dated 15th December 05.

Not sure how many Spanish have purchased.I do not think that this is the type of development that the Spanish would buy in to anyway to be residents.

Mary Louise when did your solicitor last speak or deal with UGR?.

Thank-you Gary and Dave for acting on this so quickly for us.  I'll give you my feedback tomorrow from our agent when he gets back from talking with Teresa out at La Tercia.  I will then with all my new info get back to the lawyer and see what he has to say.

These are some of the answers that Micheal gave to Theresa when she asked her questions regarding licences and planning.
 
We do have a general licence (Plan General) for the whole development.

Yes we do have the correct planning information and nobody will landgrab in the future.

It will be interesting to hear what your lawyer has to say,let us know?.

Can somebody please clarify the current situation? Do we know if all the correct paperwork is in place? I was under the impression that the paperwork was all in order etc.

Hi All

This is the information I received back in the last 10 minutes from our Lawyer,I`am sure when we have more info from United the answers will be the same.

As you are due informed, United Golf development has initiated the works for the construction of the properties in said development as they are allowed to commence them by the Building Licenses Permissions granted by the Town Hall.
 
Planning permission and assessment of land are also in force since without these licenses in place the building permission would not have been granted to the developer.
 
The Certificate of fitness for Habitation is granted at completion time when the technicians of the Town Hall check that the development has been carried out according to the architect project and the instructions contained into the Building Permissions.

That is good to see.Keep Positive.

Not to sure why Mary Louise lawyer stated problems with, The Certificate of fitness for Habitation if this is only granted at completion time.Will be interesting to find out.

Unfortunately United Golf has not replied to my email concerning the licences.

Hi All,

Our agent was out at La Tercia and in his words asked them 'very pointed questions' about the licenses and the feedback from them was that all the relevant licenses are in place he was also told that at the end of the August bank holiday/September their intention is to increase price of property by 15%.

I will now send an email back to the lawyer and tell him what I have been told and request that he do a fuller research regards the licenses.

In response to your emil Dave I may be going back to Murcia that week so I doubt if I can make Conventry.  Will know more in the next 48 hours in terms of what I need to do.
