Will UGR force legal completion?

First of all, hello to everyone.

I originally paid a 30% deposit on a 2 bed appartment in 2006, it was on phase 1 (not sure of the plot number). I was told it would be ready in the summer of 2007, but it was not ready until about May 2008. By then, my work and income had almost dried up due to the start of the recession and my wife and I split up. So I was unable/unwilling to complete as i wasn't sure what the effect of a divorce settlement would have on my financial affairs. The assumption was that I would lose my 30% deposit, UGR would keep it and try to sell the appartment on. I accepted that.
I thought that was the end of it and didn't give it a second thought until the other day I read in the news that Spanish builders were starting to take people to court in England.
UGR haven't written to me threatening action yet, and to my knowledge they haven't cancelled the contract. Just wondered if anyone else is in the same boat or has heard of others in the same boat and what has happened.
I've also noticed the published prices on UGR's website are about 50K more than what mine cost. If UGR sell mine on they stand to make more money on the sale and they keep my 50K deposit - Win, Win for them.

Hi, it seems we are not alone, did anyone get their deposit back or even part of the deposit.
Is there any way around this.

I WOULD BE INTERESTED TO KNOW IF ANYONE GOT THEIR DEPOSIT BACK AS WE CAN'T COMPLETE!
