letter from altwood taylor on behalf of the builders.
« on: October 13, 2009, 02:11:39 PM »

  Hi,
did anyone else get a letter from the above crowd informing them that not only had they lost there 50,000 deposit but that they where going to sue us for another 132,000 becos i was unable to complete on my property?
they also said they would come after my home in Ireland----they said this was all part of the agreed contract------------------i informed them by email that both the builder and MRI have been refusing to send me on a contract for past 4 years, thus i guess their loss.
Having said that, without a contract, does anyone think i would have a chance of getting my deposit back?

                                                                                   sean (donegall)

p.s i am an owner in block 8.

  Hi again folks,
i guess im replying to my own letter here but i feel there is some sort off scam occuring with the above company as again via email last night they told me they would not give me back my 50,000 deposit and they where coming after me and my home in Ireland to the value of another 132,000.
They informed me that my solicitor had signed the contract in Spain, which i never seen and requested to see for 4 years. They also seem to be in cahoots with ROLF CHRISTENSON, who works with MRI.

ANYBODY ELSE GETTING THE SAME HASSLE??

                                                             THANKS.

Hi Sean,

You should first get advice from an independent solicitor - they should explain all the options to you.

You could email your query to the independent lawyer,  Maria de Castroa Spanish Lawyer and the Director of the Law Firm www.costaluzlawyers.es or another lawyer who you could contact is www.fljordan.com speak with Felix
.
I have read and also heard that it is possible for developers to seize your assets in Span, UK / Ireland  if you dont complete on a property .

Hi Sean
We spoke a while back on the telephone but i haven't been on this forum for ages. Good to hear from you again. Sorry to hear about your problems. But i wasn't able to complete in Julyand UGR said it would be fine and that i could get out of my contract. But the paperwork never arrived and i got an email from them about 6 weeks ago saying that they were going to fine me for not completeing but gave no more detail than that. So i may be in the same boat as you but i'm not sure. If i hear any more i'll get back to you.
Take it easy!

Ivor

We too are in the same position with ATA, who are "debt recovery specialists". Has anyone managed to get a definitive response from their solicitors on what the developers rights are under the contract?

Help!! We are in the same position. No in there right mind would give me or my sister a mortgage. Anyway it seems they have. Now we can't complete. We don't have any assets  as my sister's house in no longer worth much and I don't own my own house. I was told we would not get our deposit back and we could be pursued for the rest. Good luck! If you can get it. We took legal advice.
